Terms of use
The terms on which Perioperative and Rehabilitation Older Adult Care Pty Ltd makes this website available, and how they sit alongside your rights under Australian law.
1. About these terms
This website is operated by Perioperative and Rehabilitation Older Adult Care Pty Ltd (ABN 88 699 323 478, ACN 699 323 478), a company registered in Australia and based in Perth, Western Australia. By accessing or using the site you agree to these terms. If you do not agree with them, please do not use the site.
These terms govern your use of the website. The terms on which we provide clinical services are agreed separately in writing before any episode of care begins.
2. The website is information, not clinical advice
Nothing on this website is medical, nursing, allied health or other clinical advice, and nothing here creates a clinician–patient relationship. Information is general in nature and does not take account of any individual’s circumstances. Always seek advice from a qualified health practitioner about your own situation, and never delay or disregard that advice because of something you read here.
In an emergency, call 000 or attend the nearest emergency department. Email sent to us is not monitored around the clock and must not be used to report urgent deterioration.
3. Using the site
You may view, print and download material from this site for your own personal, non-commercial use, or for the purpose of considering or making a referral to us. You must not:
- Use the site for any unlawful purpose, or in a way that breaches these terms
- Attempt to gain unauthorised access to the site, its server or any connected system
- Interfere with the site’s operation, security or availability
- Copy, reproduce, republish or commercially exploit its content without our written permission
- Use automated means to extract content, other than ordinary search engine indexing
4. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Among other things, services must be supplied with due care and skill, must be fit for any purpose made known to us, and must be supplied within a reasonable time.
For a major failure with a service, you are entitled to cancel the service contract and to a refund for the unused portion, or to compensation for the reduced value of the services. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified within a reasonable time and, if this is not done, to cancel the contract and obtain a refund for the unused portion.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that applies to you under the Australian Consumer Law or any other law that cannot lawfully be excluded.
5. Accuracy and availability
We take reasonable care to keep the content of this site accurate and current, but clinical practice and information change. We do not warrant that the content is complete, current or error-free, or that the site will be available without interruption. We may change, suspend or withdraw any part of the site at any time without notice.
6. Liability
Subject to clause 4, and to the fullest extent permitted by law:
- We exclude all conditions, warranties and representations that are not expressly set out in these terms
- We are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or anticipated savings, arising from your use of or reliance on this website
- Where liability for a failure to comply with a consumer guarantee may lawfully be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again
Nothing in this clause operates to exclude or limit liability for death or personal injury to the extent that liability cannot be excluded or limited under Australian law.
7. Intellectual property
All content on this site — including text, page structure, layout, graphics, icons, the styling and the company name and marks — is owned by or licensed to Perioperative and Rehabilitation Older Adult Care Pty Ltd and is protected by the Copyright Act 1968 (Cth) and other applicable laws. Your use of the site does not transfer any intellectual property rights to you. You may quote short extracts with clear attribution to Perioperative and Rehabilitation Older Adult Care Pty Ltd; any other reproduction requires our prior written consent.
8. Third-party links and services
Where we refer to a third party, an organisation or a service, we do so for information only. We do not control third-party content and are not responsible for it, and a reference is not an endorsement.
9. Privacy
Personal information and health information are handled in accordance with our privacy policy, which forms part of these terms and is prepared under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
10. Suspension and termination
We may suspend or terminate your access to this website at any time, without notice, if we reasonably believe you have breached these terms or used the site unlawfully. Clauses that by their nature should survive termination — including clauses 4, 6, 7, 9, 11 and 12 — continue to apply. Termination of website access does not of itself end any separate agreement for the supply of services, which is governed by its own terms.
11. Changes to these terms
We may amend these terms from time to time. The version published on this page applies to your use of the site from the date shown at the top. Please check the terms when you return to the site.
12. Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and of the courts competent to hear appeals from them.
